All rental items will remain the property of Baby Equipment Rentals Winter Park LLC at all times.

Charges will be determined based on the length of time rental items are in possession of renter based on contract dates requested. Any change to the rental period will be by verbal or written agreement only with Baby Equipment Rentals Winter Park LLC. If renter fails to surrender items on agreed return date and time, Baby Equipment Rentals Winter Park LLC reserves the right to charge the renter’s credit card for full retail value of rental items in addition to charges incurred for the rental period. All rental items must be returned to Baby Equipment Rentals Winter Park LLC staff. Equipment cannot be left at the airport or with a rental car agency. It can be left in your vacation home if previously coordinated with Baby Equipment Rentals Winter Park LLC in advance. If items are left and unable to be retrieved by 3pm on scheduled pick up date, Baby Equipment Rentals Winter Park LLC reserves the right to charge the renter’s credit card late fees of an additional day of rent for all items and an additional $35 (Winter Park, Fraser, & Tabernash) or $60 (Granby & Grand Lake) redeliver/pick up fee. If renter would like to extend their rental agreement, 24 hours notice is required, and fulfillment of the request is based on availability of rental equipment. 

Upon delivery, the renter shall inspect the items and notify Baby Equipment Rentals Winter Park LLC staff at (970) 531-3765 of any deficiencies within 24 hours of delivery. Renter will return the items in the same condition they were received. If items are returned damaged or in disrepair, including missing parts, renter is obligated to pay the cost of repair in addition to charges incurred for the rental period. If item is irreparable, renter is obligated to pay the full retail value of irreparable items in addition to charges incurred for the rental period. There will be an additional $25.00 charge for any item that is returned in exceptionally dirty condition and will be charged to the credit card on file. 

Renter authorizes and permits Baby Equipment Rentals Winter Park LLC to charge the renter’s credit card late return fees including additional day of rent for all items and additional deliver fee and / or the amount of the replacement, repair, and exceptionally dirty condition fee. Baby Equipment Rentals Winter Park LLC will not reimburse for any unused equipment. 

Renter is responsible for using the rental items for their designed purpose. If renter is unfamiliar with the way an item operates or functions, renter must request a manual or special instructions to avoid damaging an item and to avoid injury or accident. Renter understands the risks associated with the equipment, has asked Baby Equipment Rentals Winter Park LLC about any risks, and has obtained the information needed to understand these risks. Renter is liable for misuse of equipment and in the event of an accident, including death, releases Baby Equipment Rentals Winter Park LLC from any and all claims arising. Under no circumstances will Baby Equipment Rentals Winter Park LLC be held responsible for any damage, injury, or loss, including death, arising from the use of any rented equipment or the failure of the equipment to function as intended by the manufacturer. Renter is renting the equipment at their own risk and agrees to not hold Baby Equipment Rentals Winter Park LLC responsible for the risk of injury that may exist from the use or misuse of each piece of rental equipment, including the potential risk of serious injury, disability, or death. 

To the full extent permitted by law, the renter shall indemnify and hold Baby Equipment Rentals Winter Park LLC harmless against all claims, losses, damages, personal injury, death, and expenses. Including but not limited to attorney fees and costs arising any manner out of the rental or use of any rented equipment provided by Baby Equipment Rentals Winter Park LLC or the failure of the equipment to function as intended.

Delivery fees are predetermined based on delivery location and order minimums. Any trips in addition to delivery or pick-up to any location that are not the fault of Baby Equipment Rentals Winter Park LLC will incur a $35 (Winter Park, Fraser, & Tabernash) or $60 (Granby & Grand Lake) redelivery additional charge.

Equipment images appearing on the website may be stock photos. Equipment may be different than shown. The term “equipment” is defined as but not limited to cribs, strollers, high chairs, pack n plays, and more. The term “more” is referred to the rental equipment on www.berwp.com Baby Equipment Rentals Winter LLC website.

Payment for baby equipment rentals indicates that the renter acknowledges and accepts the Rental Agreement, Liability Waiver, and Terms and Conditions.

These terms are subject to change by Baby Equipment Rentals Winter Park LLC without notice. All amended terms shall automatically be effective immediately once they are posted on the website. It is the renter’s responsibility to return to these terms to review the most current version. Baby Equipment Rentals Winter Park LLC does not and will not assume any obligation to notify renter of changes to the terms. This agreement may not be otherwise amended except in writing signed by renter and Baby Equipment Rentals Winter Park LLC.
